Making an Offer

Also known as the Agreement of Purchase and Sale, an offer is a document which outlines the real property, the purchase price, and the terms and conditions set out by you (the purchaser) and the seller (or vendor). Since every sale is unique, conditions can be added at your request and for your protection. To show that you are serious about your offer, you are expected to include a deposit. The deposit can be for any amount, however, the higher the deposit the more seriously the offer may be taken.

After an offer is accepted and all of the outlined terms and conditions have been met, the contract is bound by law. It is very important to understand exactly what this means, because once the transaction is complete, there is no going back. A well crafted document will leave no stone unturned – if the MLS listing says that the house comes with appliances, this will be written into the agreement. If conditions are not met within the allotted time, your offer is no longer valid and your deposit will be returned to you.

Please note that a deposit is not the same thing as a down payment.

Some sellers will entice buyers by including chattels, or moveable articles of personal property. If there is a particular fixture that you are concerned about, always be sure to ask. A Purchase Price Checklist has been included for you to review.
