Using a Lawyer

When buying a home, you will want to consider adding a lawyer to your team of professionals. Many of the papers that you will be asked to sign, in particular the Agreement of Purchase and Sale and your mortgage financing papers, will be filled with language that is not easy to understand. Your lawyer will ensure that your rights and interests are protected before you sign these legally binding contracts. Some things to consider before hiring a lawyer:

  • Ask friends, family and co-workers for names of lawyers they know and trust
  • Always work with an experienced real estate lawyer
  • Ask your lawyer how they structure their fees
  • Ask for an estimate of costs
  • Always ask what services the fees include
  • Consider having your lawyer review all of your paperwork before you sign anything
  • Your lawyer should make sure that you have a valid title (proof of ownership) and that it is correctly described in each and every document
  • Your lawyer should investigate whether there are any claims made against the property
  • If there are claims, they should be cleared before you sign anything
  • Your lawyer should arrange for Title Insurance
  • They should find out if there are any taxes owing on the property
  • Your lawyer should calculate the amount of Land Transfer Tax and any adjustments that need to be made
  • Finally, your lawyer can draw up the mortgage documents for you
