Whose responsibility is the home inspection? Buyer or seller? - July 14, 2011

I read an article in the Toronto Star last month about a very unhappy new homeowner. Glenda Halliwell had purchased a home using the services of a realtor and a home inspector, but had waived the final home inspection at closing. She did this because she believed (falsely) that there were no major problems with her home. Four months after the inspection, and two months after closing, Ms. Halliwell's home flooded. There were clear signs of water damage, mould, mildew, moisture, rot, dust and drywall deterioration. These signs should have been recognized by the inspector and addressed before closing - but they weren't. Ms. Halliwell sued her agent, the inspector and the seller.
